A Message from the Public Advocate

To my friends and fellow New Yorkers,

Every year, I’m honored to have the opportunity to speak to people throughout the city, about the state of our neighbors, our communities, our concerns — the state of the people. Next week, I’ll be delivering my annual State of the People Address, and I want to invite you to attend, so you can hear from me directly about what I feel our city needs at this moment. This is a pivotal time, one where we can learn from the past and look to the future, and I’d be honored to have you there.

Please join me on Wednesday, May 22 at 1 PM in Jamaica, Queens for this important, annual address as I cover some key topics and look back on my office’s landmark victories over these past years, and discuss my agenda moving forward in the years ahead. RSVP here for the State of the People if you’d like to attend, and while at the event, I encourage you to share your thoughts and takeaways on social media, using the hashtags #PeoplesNYC and #SOTP2024! 

I first came into office five years ago, and since then, I’ve made it my mission to elevate the needs of New Yorkers, especially those whose voices aren’t often uplifted or heard, raising their voices with my own, and fighting to address those needs through policies and programs. In my speech next week, I want to reflect on where we’ve come from, confront what we’re facing, and look to where we can go together. We are stronger in solidarity, at our best when we work together to improve the city we all love, and I want to use this opportunity to lift all of our voices, together.

OPWDD released for comment a draft ADM, ADM #2019-06R which describes the service, program and payment standards, and service documentation requirements to support a provider’s claim for Medicaid reimbursement for Support Brokerage. Support Brokerage Services are available for Home and Community-Based Services (HCBS) Waiver authorized individuals who Self-Direct their services. Individuals Self-Directing their services receive an individualized budget that they direct pursuant to an approved plan.  The ADM incorporates the term ‘Care Planning Team’ and clarifies required and allowable billable services, meetings, and documentation requirements. Comments are due to OPWDD by May 23, 2024.

On April 25, 2024 OPWDD posted online 24-INF-03, regarding Fetal Alcohol Spectrum Disorder (FASD).  The purpose of this informational letter is to describe the current state of research and understanding of FASD, the leading preventable cause of intellectual disability, and to describe FASD in the context of OPWDD eligibility criteria.  This Informational Letter will review what FASD is, how the diagnosis is made, risk factors for FASD, prevalence of the condition, and OPWDD eligibility considerations for a FASD diagnosis.

On April 23, 2024 OPWDD posted online 24-INF-02 Communication in Developmental Disabilities and Autism Spectrum Disorder: Empirically Supported and Unsupported Communication Enhancement Methods.  This Informational Letter discusses the different communication methods for individuals with developmental disabilities that have empirical evidence to support their use

On April 17, 2024 OPWDD issued a Frequently Asked Questions document titled, Licensing Exemptions Law Questions. In alignment with OPWDD’s goals to improve communications, collaborations, and increase clarity of policies and practices, this document was created to be responsive to questions shared with OPWDD and requests made by our stakeholders. The information contained in this document is for general educational and informational purposes only and represents the opinion of OPWDD.  For any questions regarding licensure requirements, please contact the NYS Education Department (NYSED) directly.

Registration is open for the Virtual After School Art Program, Friends are We! Building Social Skills through the Arts!February – June 2024This interactive after-school program will offer children with Autism Spectrum Disorders (ASD), from ages 3 up to 13 years old, with social skills development through the arts. The program involves the participation of students’ parents to learn skills taught and then to reinforce them at home and in their communities. Students will explore various visual art forms in an interactive small group setting. TRAVEL TRAINING:Traveling with Strangers and Problem Solving – Pt. 2YAI – Seeing Beyond DisabilityDate: June 5th, 2024Time: 10:30am-12pmTraveling with Strangers This training will review proactive strategies for traveling alongside strangers, including how to identify a stranger, how to respond if a stranger approaches, and how to recognize potentially dangerous situations while traveling in the community.  
Problem Solving: Getting Lost When traveling on public transportation, unexpected issues may arise. Skills for dealing with these unanticipated moments should be practiced. This presentation will review how to recognize when you are lost, resources in the community to help problem solve and where to access help when needed.
